Enjoy Lesson "Terms and Condition of Membership"

1.About "Terms and conditions of membership"

(1)This language-teacher matching site "Enjoy Lesson" is offered through www.enjoy-lesson.com ("the Website") and provided and operated by Compufranca Ltd. ("Compufranca", "we" or "us").
The express terms of this "Terms and conditions of membership" represents the entire agreement between Compufranca and you relating to its subject matter by registering for membership with Compufranca.
(2)By using the services as a member, you are subject to accept and agree these Terms of Membership.

2.Membership definition

People who have completed the registration on the website and have been approved by us are registered members.

3.Membership cancellation

(1)The membership may be cancelled in the following ways.

(i)Go to the "Inquiry" page on the Website and choose "Cancellation of membership" from the "Inquiry type" and write "Cancel membership" in the "Inquiry title". In the "Inquiry content", please enter your member ID and login ID and let us know that you want to cancel and why.
(ii)Send e-mail to our support mail address, as the "subject", please write "Cancel membership".
In the message, please let us know that you want to cancel and why. Please include your member ID and login ID in the message.
Once we received the notice and confirmed it, the cancellation shall be completed.

(2)Once your cancellation is completed, your information will not be displayed on the Website..

4.Login ID and Password management

(1)We will issue a login ID and password to the member.
(2)You are responsible for the use and management of the login ID and password.
(3)You must not give or rent the login ID and password to any other person or third party.
(4)We will accept no responsibility for any damage caused by a third party using your login ID and password (whether innocent, negligent or otherwise).
(5)If you lose your login ID or password, please inform us immediately and follow our instruction.
(6)Access to the Website by login ID and password is solely for registered members.

5.Change of registered information

If there is any change in registration information, please notify us of the change immediately.
You are liable for any loss due to the notification delay.

6.Termination of membership

(1)We will terminate your membership immediately without notice under the following circumstances.

(i)If you attempt to interfere with our services.
(ii)If you fail to comply in full with any of the Terms and Conditions.
(iii)If we are unable to contact you by registered e-mail or other methods.
(iv)We also reserve the right to terminate your membership if we decide you are no longer appropriate as a member.

(2)We shall have no liability for any direct, indirect or consequential losses or expenses suffered by you due to the termination of membership by any of the above mentioned circumstances.
You are responsible for compliance with all relevant Laws, if any, for any and all losses caused to us or a third party, even if your membership has already been terminated.

7.Information deletion

We will delete inappropriate registration information with or without notice to you.

8.Receipt documents

We will not return any document you submit to us (e.g. copy of identity document etc.).

9.Privacy policy

We manage user’s personal information under our "Personal information handling rule".
Please refer to the "Privacy Policy" page for details.

10.Changes to the "Terms and Conditions"

This "Terms and Conditions" may change at any time without notice. Any modification will be published on the website for 1 month and your continued use of this service is subject the new "Terms and Conditions".

11.Jurisdiction

In the case of trouble between Compufranca and users regarding the use of this website, Compufranca and the user shall work to meet agreement under the Terms and Conditions and other terms.
If Compufranca and the user cannot reach agreement, we will take the matter to Osaka district court or Osaka minor court.

12.Governing law

The "Terms and Conditions" shall be governed by and construed in accordance with the law of Japan.

Enjoy Lesson "Terms and Conditions of Services"

1.About "Terms and Conditions of Services"

(1)This language-teacher matching site "Enjoy Lesson" is offered through www.enjoy-lesson.com ("the Website") and provided and operated by Compufranca Ltd. ("Compufranca", "we" or "us").
The express terms of this "Terms and conditions of Services" represents the entire agreement between Compufranca and you relating to its subject matter by using the services.
(2)By using the services, you are subject to accept and agree these Terms of Services.

2.Service outline

(1)Introduction service
The Enjoy Lesson Introduction service's purpose is to introduce teachers to students who are looking for language teachers. Students search teachers’ profiles and they are able to get their contact information.
Validity period of this service is one year after students pay the service charge. Within that period, students are able to exchange messages which include contact information with teachers.
(2)Point service
By using the "Point service", students are able to purchase points and send payment for online lessons, phone lessons, proofreading or translation etc. to teachers by using the points instead of cash or other payment methods.

For the other related services, please refer to the "Service Guide" page.

[For Students]

3.Using this service as student

You are required to meet following criteria. If we notice that you don't meet the criteria, we will delete your member registration.

(i)Residing in Japan
(ii)Looking for a language teacher
(iii)20 years old or over. If you are under 20 years of age, you cannot register, but your parent or legal guardian may register for you.

4.Registered teachers

(1)We do not employ or have any contractual relationship with teachers.
(2)We have no power or authority over the registered teachers.
(3)Majority of the registered teachers are not fluent in Japanese.
Please refer to each teacher’ s profile regarding his or her language skill.
(4)We provide the teachers’ contact information, but do not guarantee to match any or all students with any or all teachers by using the services.

5.Registered teaches profile

(1)The profile information is self reported by teachers. We do not guarantee the credibility and/or accuracy of the content.
(2)We expect the teachers to register accurate information and ask them to take identification documents (passport, VISA or alien registration certificate) and qualifications, academic records or job history documents, to prove their identity and qualifications match their profile at the trial lesson or the first lesson proper.
(3)If you find any false or inappropriate content in the profile, please inform us immediately. Once it has been confirmed, we will edit or delete it.
(4)We are working to improve the information accuracy by checking at the time of registration and on a regular basis.
We also appreciate students' feedback.

6.Introduction service charge

Please refer to the "Price List" page.

7.Notes on using Introduction service

Our "Introduction service" aims to overcome the biggest problems students have in regard to contacting teachers.
These problems typically include teachers leaving in Japan or otherwise becoming unavailable without letting students know; they delay responding to messages, enquiries, etc. or fail to respond at all; they move around the country and change phones and e-mail addresses; etc. To alleviate these problems, we recommend that students negotiate lesson conditions with selected teachers using our "Messaging service" before applying for our "Introduction service".

8.How to contact to teachers after applying for Introduction service

(1)You can contact the teacher directly after requesting an exchange of contact information.
You can see teachers’ contact information on the "Previously disclosed contacts" page.
(2)The communication language will be normally in English. If you are not sure how to write an e-mail in English, please refer to the "First contact" page on the website.
(3)You may not have a reply back from the teachers straight away for various reasons, but please remember that we are not liable for that.

9.Lesson fee

(1)You shall pay the lesson fee to the teacher directly when you meet the teacher and take lessons.
(2)We advise you to make agreements with your teacher regarding the following matters before the lesson to avoid any trouble.

(i)Trial lesson fee
(ii)Regular lesson fee
(iii)Travel cost, teaching materials costs and coffee costs
(iv)Payment method for the lesson (We advise you to pay for each lesson as you have it, not multiple lessons up front.)

10.Using Point service

You can use the "Point service" as long as your applied "Introduction service" is valid.

11.Point prices and charges

Please refer to the "Price List" page for point prices and operational charges.

12.How to purchase points

Please refer to the "User Guide" page for point purchase procedure. Purchased points will be available after your payment is confirmed by us. You can see the available point balance on the "Point balance and transactions" page.

13. Purchased point validity period, expired timing and cashing-in

Purchased points are available within the validity period of your applied "Introduction service". If you renew the "Introduction service", the point balance will be carried over until the expiry date of the renewed "Introduction service". Please note that you cannot cash-in available points under any circumstances and they will expire in the following cases.

(1)Your membership of our site is cancelled; or
(2)Applied "Introduction service" expires

14. Payment of lesson fee etc. using points

(1)You can transfer points that have been negotiated with a teacher in cases where you cannot meet with the teacher in person (e.g. online lessons using phone / Internet (Skype) or Proofreading / translation via e-mail / FAX / Live chat).
(2)Transferred points will be settled 14 days after you transfer the points.
(3)You can request to cancel the point transfer before the transfer is settled in the cases that the number of transferred points is incorrect, recipient of point transfer is incorrect, the lesson has not been held, or the proofreading or translation has not been performed.　The cancellation will be performed when it is approved by the teacher. If the cancellation is not approved within 7 days after it has been requested, the point transfer will be suspended by us. In the case of suspended transfers, please contact the teacher and resolve whether it should be cancelled or settled with the teacher, then inform us of the decision using the "Inquiry" page. After that, we will cancel or settle the transaction based on the decision.

15. Notes on payment

Payment will be confirmed normally within 24 hours for bank transfer (except weekends and bank holiday), we will send the confirmation after the transaction has been completed. Please inform us from the "Inquiry" page on the website if you didn’t receive the payment confirmation. We will investigate immediately.

16.Refund

(1)About cancellation of the purchase
You can cancel the purchase from the "Inquiry" page on the website before your payment is completed.
Once you have received our payment confirmation, we will not refund any charges except for the reason mentioned in (2).
(2)Accepted cancellation reason after payment is confirmed

(i)You couldn't get any contact information from teachers as a result of negotiation with teachers..

(3)How to request a refund
If you wish to cancel a purchase, please go to the "Inquiry" page on the Website and choose "Refund request" from the "Inquiry type", write "Refund request" in the "Inquiry title" and purchase number in the "Purchase No.".
In the "Inquiry content", please include the following information:

(i)Your member ID, login ID
(ii)Reasons of refund request
(iii)Name of the bank, branch, account number and account holder name for refund.

(4)Refund method
We will transfer the refund money into your bank account.
Any Bank transfer handling charges will be deducted from the total amount of refund.
(5)Others
We will not pay any interest on refunded charges.

17.Liability and student problems

(1) We do not guarantee the followings:

(i)That you can contact every registered teacher.
(ii)That you can make agreements with teachers and start the lesson.
(iii)The credibility and accuracy of teachers' profiles

(2)We only provide teachers’ contact information, but we do not have employment relationships with teachers.
Therefore, you are responsible for the followings:

(i)Any of your dealings with your teachers.
(ii)Any risks you may have by using the services.
(iii)Any troubles or liabilities with teachers.

18.Prohibited matters for students

By using the services as student, the followings are prohibited. If you breach any of these restrictions, you will lose the right to use the services immediately. (i) Asking teachers for anything other than teaching related matters. (ii) Abusing or being offensive to teachers (iii) Passing the contact information to any third party, with or without charge

[For Teachers]

19.Using this service as teacher

You are required to meet following criteria. If we notice that you don't meet the criteria, we will delete your member registration.

(i)Residing in Japan
(ii)Looking for students as a language teacher.
(iii)Having a resident permit. (If you don’t have Japanese citizenship.)

20.Profile registration

Please note following when you register your profile.

(i)You must register correct information. (Do not register false or inappropriate information.)
(ii)When your submitted identification documents are updated, please re-submit copies of them to us promptly.
(iii)If there are any changes in your contact information, please inform us promptly.
(iv)Do not enter your personal contact information (telephone number, e-mail address or URL) in remarks or comment boxes.
(v)If you are unable to offer lessons any longer,

-Choose "Undisclosed" option at "Disclose profile" on the "Modify member information" page.
When you choose "Undisclosed", your profile will not be disclosed to students.
-Check "No" option at "Disclose in profile?" for each language on the "Modify member detail information" page.
Any lessons not disclosed will not be included in students' search results.
-Apply to cancel your membership

21.Information in your profile

Please remember:

(i)All fields marked # on the registration form will be published on the website.
(ii)Identity verification information will not be published.
(iii)In the case that you disclose your contact information (e-mail address, mobile mail address, phone number, Skype ID) to students, the information will be disclosed on the students' page. You can choose which contact information to disclose every time a student requests your contact information, and you can change or withhold contact information which you have previously disclosed to any students.

22.Contact with students

Please be reminded following matters.

(i)Reply to students promptly.
(ii)Bring identification documents and qualifications or academic records to prove your profile information at the trial or first lesson.
(iii)Make agreements with your students about lesson fee, travel cost and cancellation fee before the first lesson.
(iv)You must comply with the "Contact notes" on the website.

23.Payment in cases where you meet with students and have lessons

In cases where you meet with students and have lessons, please remember:

(i)Receive the lesson fee directly from your student, not through us.
(ii)In order to avoid any troubles, receive the fee after the lesson each time, not multiple lesson fees up front.

24. Using point service

You are able to get paid by students using our "Point service" in the case that you cannot meet with the students (e.g. online lessons using phone / Internet (Skype) or Proofreading / translation via e-mail / FAX / Live chat).
If you use our "Point service", you must remember that charges are incurred when cashing-in points.

25. Payment of lesson fee etc. using points

(1)Points transferred by a student are settled by us 14 days after the student requests the transfer. After settlement, you can make a request to cash-in the points.
(2)You may receive a cancellation request from the student before settlement (As mentioned in this "Terms and Conditions of Services" students are able to request to cancel the point transfer in the cases that the number of transferred points is incorrect; recipient of point transfer is incorrect, the lesson has not been held, or the proofreading or translation has not been performed). The cancellation will be performed when it is approved by you. If the cancellation is not approved within 7 days of request, the point transfer will be suspended by us. In the case that it’s suspended, please contact the student and resolve whether it should be cancelled or settled with the student, then inform us the decision from the "Inquiry" page. After that, we will cancel or settle the transaction based on the decision.

26. Cashing-in points

Please refer to the "User Guide" for cashing- in points. After you make a request to cash-in points, payment will be processed within 5 working days. Some financial institutions may take up to 5 working days to make payments after we transfer funds to them.

27. Charges incurred when cashing-in points

Please refer to the "Charges incurred when cashing-in points" page from the "Price list" page, the "Register payment account" page or the "Point balance and transactions" page.

28. Received points expiry

Received points will expire in the following cases.

(1)Your membership of our site is cancelled
(2)You fail to respond to us within 3 months of our attempt to contact you by your registered PC e-mail or phone.

29.Liabilities and teacher problems

We do not guarantee the followings:

(i)That you will receive contacts from students.
(ii)That you will reach the agreement to start lesson.
(iii)That you will receive the lesson fee from students.

30.Prohibited matters for teachers

By using this service as teacher, we prohibit the following.
If you breach any of the restrictions, you will lose the right to use the services immediately

(i)Forcing the student to do anything for you is strictly prohibited.
(ii)Abusing or being offensive to students.
(iii)Introducing your students to any other teacher.
(iv)Passing the information of the students to a third party with or without charge.

[For Students or Teachers]

31.Liability and problems using this website

(1)You use the website at your own risk.
(2)We accept no liabilities or responsibility following:.

(i)If there is any false information on the website.
(ii)If the website is illegally accessed by any third party and modified or any information leaked. (including by hackers)
(iii)If you face any troubles caused by using our service or by not being able to use our service.

(3)It is your responsibility to deal with any claim you caused by breaching the "Terms and Conditions" or violation of the right of any third party.
You are subject to any incurred costs or compensation (including legal expense) we suffer by dealing with any claim which is your fault.

32.Termination of the service

We reserve the right to terminate your use of the service immediately without notice if you fail to comply in full with any of the Terms and Conditions.

33.Service suspension

We may temporarily suspend any part of our service with or without notice to you for the following reasons.
You confirm that we shall not be liable to you or to any third party for losses caused by the service suspension.

(i)Regular or urgent system maintenance
(ii)Unable to provide the service due to natural disaster or unavoidable problems such as fire, power failure, earthquake, flood or tsunami.
(iii)If we decide that operational or technical suspension is required.

If you have any queries or comments about the service, please use the "Inquiry" page on the website.
We do not accept any telephone inquiries.
